Cannabinoid Shipment In The EU: Can You Ship CBD Products And Which Carrier Will Ship Them?

Please keep in mind that when this post mentions cannabinoids or cannabinoid products
, it is referring to cannabinoids extracted from hemp, not marijuana.
The market for cannabinoids is currently thriving. It shouldn't take long to realize that this is one of the fastest-growing product categories, with products ranging from cannabis water and CBD toothpaste to cannabinoid-infused dog treats.
Cannabinoids are currently available almost everywhere, from supermarkets to teen brands. Other businesses, besides big-box retailers, benefit from increased legality and exposure. Both local physical establishments and online retailers are growing.

The statistics are conclusive:

The EU medical cannabinoids market was worth approximately 4,5 billion Euros in 2022. The EU medical cannabis market is expected to reach 13 billion Euros by 2027.

More than 10% of the EU population has used a cannabis-related product. One in every seven of those people regularly consumes CBD. 49% of consumers purchased cannabinoids in a store, while 43% purchased them online.

It's tempting to get into the cannabinoid industry for yourself, given the industry's steady growth and a market that demonstrates it's more than just a fad. You must, however, first do your research and become acquainted with safety procedures, regulatory requirements, and the specifics of selling and delivering cannabinoids.
To begin, one of the active ingredients in cannabis is a cannabinoid known as CBD (cannabidiol). Although the European Food Safety Authority (EFSA) will step in if claims are made that the products can cure, mitigate, treat, or prevent disease, CBD is thought to relieve symptoms without the psychoactive effects of THC (tetrahydrocannabinol, the component of marijuana that makes you high). Users, for example, report that it relieves pain and relieves occasional anxiety.

Cannabis containing more than 0.3% THC is illegal in many EU countries, including the Netherlands. Cannabis with less than 0.3% THC, also known as "hemp," is permitted, though laws in other EU countries may differ. Before selling cannabinoids-containing products, you should research the legal requirements in each country. More information on this topic can be found in our article EU Laws for Cannabinoids in 2023.

Similar to alcohol, legal restrictions limit the amount of THC and other ingredients that can be used in hemp-based products. In some countries around the world, the maximum amount of THC allowed in hemp products is zero. This means that any products containing cannabinoids derived from hemp must be THC-free. Hemp-derived cannabinoids are legal in the EU if the THC content is less than 0.3%.

This is due to the final proposal of the Common Agricultural Policy (CAP). The European Parliament voted in October 2020 to raise the permitted THC level on the field from 0.2% to 0.3%. The new CAP went into effect on January 1, 2023. This post will go over safe and legal methods of delivering cannabinoids to both you and your customers.

Is it legal to ship marijuana? Four Things to Think About ?
Despite being widely recognized and legal, cannabinoids are highly regulated and supervised. You can determine whether the cannabis sent by your provider is legal by using the following indicators.

1. The location of the plant’s origin.

Your company should only sell cannabinoids derived from hemp plants and not marijuana. Consult with a lawyer if your cannabinoid is synthetic, but the THC content must be 0.3% or less. To ensure that the items meet this standard on a consistent basis, you must keep a close eye on any suppliers or other partners you may have.

1. THC and cannabinoid effectiveness

You must be able to provide written proof of the cannabis and THC content of the products you transport, and the THC level of the cannabinoid you transport cannot exceed 0.3%.

3. Permits.

All cannabinoid-containing products, whether purchased from a distributor or grown by yourself, must come from a registered grower. In other words, you can't just take your uncle's experimental cannabis plants growing in his shed and move them. You should consult with an attorney before bringing marijuana into Europe.

If you sell illegal goods, you and your supplier risk legal trouble, detention, and business closure.

4. Testing

Independent testing of your cannabinoid-containing products is required to demonstrate their chemical composition, including THC level. Third-party testing may be required as a prerequisite for some of the aforementioned requirements.

Cannabinoid Shipping

Cannabinoid shipping is somewhat complicated because you must ensure that the product is legal to ship from the point of origin and legal to receive at the destination, in addition to adhering to any shipping carrier restrictions. Let us investigate who can and cannot ship cannabis.

1. No, you do not satisfy the aforementioned requirements.

If you cannot absolutely establish that you have met all of the aforementioned prerequisite conditions, you risk violating the terms and conditions of the authorised carriers listed below.

You could face consequences, including arrest, if you try to mail Cannabinoid with a THC concentration of 0.3% or higher. At the very least, your products may be discovered and destroyed while in transit.

2. Your cannabis business meets all the legal standards.

You may only sell cannabinoids containing 0.3% THC or less
if you:
Have all necessary licenses, such as a grower, processor, or retailer license;
Solicit only from growers who run legal, licensed businesses.
Have a third-party testing process in place, with documented results.
If you meet all of these criteria, you should be able to ship cannabis to countries where it is legal to do so. (via the authorized carriers listed below).

Top Carriers for Cannabinoid Transport

Over time, shipping companies have compiled a list of permissible cargo. You may send cannabis if it is legal, sent only to authorized regions, and meets the requirements of the following shipping companies:

DHL

DHL will transport cannabinoid products if the following conditions are met:
The shipment complies with all applicable EU and local laws; the shipper keeps records proving compliance, such as laboratory test results, licenses, or compliance reports;
The shipment contains no more than 0.3% THC by dry weight hemp or hemp-based products.

Certificates and other documentation may be required at any time; however, shippers are not required to submit such documentation at the time of shipment.

UPS

UPS will allow you to send cannabinoids if you have a license to grow industrial hemp and the tetrahydrocannabinol (THC) concentration of such hemp (or its derivatives) does not exceed 0.3%.

To ship cannabinoids via UPS, you must be able to identify the raw materials' origin, how they were processed, and how you acquired them. (Alternatively, who shipped the product to the supplier and how that supplier got it to the customer after the fact).

UPS will only transport hemp-based products, including cannabidiol, that comply with all EU and local regulations. It is the Shipper's responsibility to ensure that all applicable laws are followed.

UPS reserves the right to reject any shipment containing Marijuana, Hemp, or Hemp-based products that Shippers are not permitted to transport, UPS is not permitted to accept, UPS indicates it will not accept, or UPS has the right to refuse.

UPS will not accept packages containing Hemp items from Marijuana or Marijuana-related product retailers.

Three Things to Consider Before Beginning to Fill Cannabis Orders

Now that you understand the fundamentals of legally exporting marijuana, there are a few additional considerations to ensure that you cover all of your legal bases.

1. Exercise caution when shipping internationally.

You may face charges or have your goods destroyed if you attempt to transport a hazardous material to a country outside the EU. Cannabis and its derivatives are illegal in many countries.

Make sure you're up to date on the locations where your company can legally ship marijuana products. Shipping may be difficult even in countries where cannabis is legal. If you are based in the EU, it may be more prudent to ship within Europe rather than attempting to expand beyond.

2. Double-check your service providers.

If you deal with a supplier rather than managing your own farms, processing/manufacturing facilities, or anything else, make sure they do not violate any limits or shipping regulations, whether they relate to the potency of their marijuana, where it is grown, or anything else.

3. Speak with a legal advisor

Ensure that your legal team reads your disclosures and understands where you intend to ship your marijuana products, if applicable. Despite the fact that the cannabis industry has grown rapidly and dramatically, the sale of hemp-derived products is still prohibited in several jurisdictions. If you are unsure, it is best to consult a lawyer. Each EU member state has its own set of rules and regulations.

Conclusion

Shipping items is an important part of running a successful cannabis business. Furthermore, you will require everything from authorized payment processing to innovative cannabis marketing methods that adhere to the norms and guidelines imposed by government agencies and digital behemoths such as Facebook.

Cannabinoids are far more difficult to sell than apparel or novelty items, but the market is rapidly expanding. Changes in government and society have recently occurred, but they are not expected to be permanent. To stay up to date on any changes, make sure you are familiar with the marijuana regulations of various countries as well as the cannabinoid shipping rules of various carriers.
